I am sorry to hear that your DD had an unsuccessful review, I am afraid the stats show that it is very hard to achieve with a score of 108. It is also quite difficult, as you have read, to win and appeal after an unsuccessful review as you have to prove that it was not FCO
• How can a child with learning difficulty will reach the panels expected academic ability? (having known that the disability was diagnosed only after the results and the child was not under any provision for learning support) Can we say the process is flawed or can we say our daughter was not treated fair?
It is always very difficult when the diagnosis is found after the results have come out - this is something that we see each year, it is good that now you know and can ensure that she gets the help that she needs. An appeals panel would probably say that the process is fair in that all the children have to reach the same level - if your DD had been given extra help at school then she may have been granted extra time for the test - did she have extra time at all for other exams ? how did she get on in her SATS?

• Can we ask the school to substantiate why the school has not taken the triggers (Year 3-Year 5) from Reading/Writing and assessed her for any difficulties or even reached the parents to do it privately?
this would be something to discuss with the school, not with the appeals panel - as I mentioned above we do see a lot of people getting diagnoses of dyslexia etc round about this age
• Can we retrospectively prove to the appeal panel if the school has picked her academic triggers, we could have steered our DD better which in turn gets her a better score with the extra time in her exams? The entire process from STTS, Undiagnosed Dyslexia and Selection Review made a toss on her self-confidence too.
I suppose it might be possible to say that if she had had extra time then she may have scored higher, though it would be very hard to say how much. You have to also consider whether or not it would be better for her to get help with her dyslexia and make good progress at an upper school - it is possible that her head teacher and the review panel think at present that she would struggle at a grammar school and that may dent her confidence even more.

Have you got a good alternate school for her? have you looked a the SEN provision at the schools to see where she could get most help?
• Is there a different scoring standards or norms for children with disability at schools ?
I am not aware of any though some schools set children different targets based on their ability and progress
• Can I hire a solicitor to prove our case?
