No, both pupils would get a place as the panel has deemed that they should have one All cases are considered on their own merits, both for non qualification & over subscription. In the over subscription part the panel have to be convinced that the detriment to the pupil of not being admitted is greater than the detriment to the school of admitting another pupil.Thanks. So with my example, student A would be told they had a place and admitted in the new academic year, and then student B would be told the appeal was upheld but added to the waiting list. And am I correct in thinking that with the under qualification part of the appeal, they do NOT compare cases, but put each though (or don’t) on their own merit?
